  1. Scope and contracting party

These Terms and Conditions apply to all orders placed through the online shop at www.wimpire.shop.

We deliver to consumers and to entrepreneurs in Austria and Germany. Some provisions of these Terms apply only to one of these two groups and are marked accordingly.

Deviating terms of the customer do not become part of the contract unless we expressly agree to them in writing.

  1. Our products

Our products are intended for professional use in the field of eyelash extensions and require corresponding professional training. Please observe the safety and application information on the product and in the product description.

  1. Conclusion of contract

The presentation of products in the online shop is not a binding offer but an invitation to place an order.

By submitting your order using the button that completes the ordering process, you make a binding offer. We confirm receipt of your order without delay by e-mail. This confirmation of receipt does not yet constitute acceptance.

The contract is concluded once we expressly declare acceptance or dispatch the goods.

Before submitting your order you can review your entries in the cart and during the ordering process at any time and correct them using the correction functions of your browser or of the shop.

We store the text of the contract and send it to you together with the order confirmation by e-mail. The contract languages are German and English.

  1. Prices

All prices stated are final prices. Due to the small business regulation pursuant to Section 6 (1) (27) of the Austrian VAT Act, we do not show and do not charge value added tax.

Shipping costs are charged in addition and are shown separately in the cart and during checkout before you complete your order. Details can be found in our Shipping Information.

  1. Payment

The payment methods displayed during the ordering process are available, in particular credit card, Shop Pay, Apple Pay, Google Pay, PayPal, Klarna and local payment methods such as EPS.

Payment is due upon conclusion of the contract unless the selected payment method provides otherwise. Where payment is made through a third-party provider, that provider's terms apply in addition.

  1. Delivery

We ship to the delivery address you provide in Austria or Germany.

Information on processing and delivery times can be found in our Shipping Information. Stated delivery times are estimates unless a binding delivery date has been expressly agreed.

If an ordered product is unavailable, we will inform you without delay and refund any payment already made.

  1. Retention of title

The goods remain our property until payment has been made in full.

  1. Right of withdrawal and returns

Consumers have a statutory right of withdrawal of fourteen days. The details, the exceptions and the model withdrawal form can be found in our Right of Withdrawal, Returns and Refunds policy.

Excluded from the right of withdrawal are, in particular, sealed goods which are not suitable for return due to health protection or hygiene reasons if the seal has been removed after delivery.

Entrepreneurs have no statutory right of withdrawal. In this case, the return provisions of our Right of Withdrawal, Returns and Refunds policy apply.

  1. Warranty

The statutory warranty provisions apply.

For consumers, warranty is governed by the Austrian Consumer Warranty Act and the Austrian Civil Code. The warranty period is two years from delivery.

For entrepreneurs, the warranty period is one year from delivery. Entrepreneurs must inspect the goods without delay after receipt and notify us of any recognisable defects without delay.

Please observe the storage and shelf life conditions stated on the product. In the case of adhesives, improper storage can change the properties of the product.

  1. Liability

We are liable without limitation for damage resulting from injury to life, body or health, and for damage caused intentionally or by gross negligence.

In cases of slight negligence we are liable only for the breach of a material contractual obligation, meaning an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In such cases liability is limited to the foreseeable damage typical for this type of contract.

Liability under the Austrian Product Liability Act remains unaffected.

Any further liability is excluded.

  1. Applicable law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law does not affect the mandatory consumer protection provisions of the state in which you have your habitual residence.

  1. Place of jurisdiction

For disputes with entrepreneurs, the court with subject-matter jurisdiction in Graz has exclusive jurisdiction.

For consumers, the statutory places of jurisdiction apply.

  1. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

  1. Final provisions

Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the applicable statutory provision.
